End User License Agreement (EULA)

Effective Date: April 29, 2025

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "You") and OsnaDigit UG (haftungsbeschränkt) ("Licensor," "We," "Us," or "Our") for the use of the Finanzbook mobile application ("App").

By installing, accessing, or using the App, You agree to be bound by the terms and conditions of this Agreement. If You do not agree to these terms, do not install or use the App.

1. License Grant

Subject to the terms and conditions of this Agreement, the Licensor grants You a limited, non-exclusive, non-transferable, and revocable license to install and use the App on your mobile device solely for personal, non-commercial use.

2. Restrictions

Distribute, sell, lease, or sublicense the App to third parties;
Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App;
Modify, adapt, or create derivative works based on the App;
Use the App in any unlawful manner or for any unlawful purpose;
Remove or alter any proprietary notices or labels within the App.

3. Ownership

The App, including all intellectual property rights (such as copyright, trademarks, and patents) related to the App, is owned by OsnaDigit UG (haftungsbeschränkt) or its licensors. All rights not expressly granted in this Agreement are reserved by the Licensor.

4. Subscription Services

Finanzbook offers certain premium features and subscription-based services. If you subscribe to any of these services, the following terms apply:

Subscription plans and pricing details are available within the App.
Subscription payments will be processed through third-party payment providers (e.g., RevenueCat).
Subscriptions will automatically renew unless you cancel your subscription through your app store account settings before the end of the current period.
You may manage and cancel your subscription at any time through the App Store or Google Play Store.

5. Privacy and Data Collection

Your use of the App is also governed by our Privacy Policy. We collect and process personal data in accordance with the General Data Protection Regulation (GDPR). Please review our Privacy Policy to understand how we collect, use, and protect your data.

6. Updates and Maintenance

The Licensor may periodically release updates or new versions of the App. These updates may include bug fixes, improvements, or new features. By accepting this Agreement, You consent to the automatic updating of the App, including any patches or updates necessary to improve security or functionality.

7. Termination

This Agreement is effective until terminated. You may terminate it by uninstalling the App from your device. The Licensor may terminate this Agreement at any time if You fail to comply with any of the terms and conditions of this Agreement. Upon termination, You must cease all use of the App and uninstall it from your device.

8. Limitation of Liability

To the fullest extent permitted by law, the Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data arising from your use of the App, even if the Licensor has been advised of the possibility of such damages.

The Licensor’s liability for any claim arising under this Agreement shall be limited to the amount you paid for the App (if any) during the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Licensor, its affiliates, employees, and agents from and against any claims, damages, liabilities, costs, and expenses arising out of or in connection with your use of the App or your violation of this Agreement.

10. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Germany.

Any disputes arising under or in connection with this Agreement shall be resolved through binding arbitration in Germany, or in the competent court located in Greven, Germany.

11. Miscellaneous

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The Licensor’s failure to enforce any provision of this Agreement shall not be deemed a waiver of future enforcement of that or any other provision.
